    Debt recovery in Switzerland

Switzerland's unique Betreibung system handles debt enforcement through local prosecution offices — fast, cost-effective, and taken extremely seriously by Swiss debtors.

Switzerland's debt collection system is unlike anything else in Europe, and that's precisely why it works so well. The Betreibung — literally "prosecution" — is handled not by courts but by local enforcement offices called Betreibungsämter. There are no lawyers involved at the initial stage. No judges review the claim. The creditor files a Betreibung, the Betreibungsamt serves it on the debtor, and the debtor has 10 days to formally oppose. If they don't oppose, enforcement proceeds directly to asset seizure or bankruptcy proceedings. The entire system operates with Swiss precision, which is to say it operates on time, every time, without exception.

What makes the Betreibung extraordinarily effective is its impact on the debtor's credit record. Every Betreibung is registered at the local Betreibungsamt, and anyone can request an extract (Betreibungsauskunft) showing the debtor's collection history. Banks, landlords, suppliers, and business partners routinely check these extracts before entering into commercial relationships. A company with active Betreibungen on its record faces immediate practical consequences: credit facilities reviewed, supplier terms tightened, lease applications questioned.

Swiss debtors understand this calculus perfectly, which is why the opposition rate on Betreibungen is remarkably low. A legitimate debt that the debtor knows they owe — and Swiss accounting practices mean they almost certainly know — will typically be paid within the 10-day opposition period. The debtor isn't paying because of legal pressure in the traditional sense. They're paying because the cost of not paying — the Betreibungsauskunft entry, the credit rating damage, the reputational impact — far exceeds the invoice amount.

For international creditors, the Swiss system is accessible but requires understanding its cantonal structure. Switzerland has 26 cantons, each with its own Betreibungsämter and minor procedural variations. The language of proceedings matches the canton: German in Zürich, French in Geneva, Italian in Ticino. Filing must be made at the Betreibungsamt of the debtor's registered domicile.

    Primary Legal Instrument

    BETREIBUNG

Debt enforcement through local prosecution offices rather than courts. The debtor has only 10 days to oppose — Betreibung records affect credit ratings, making Swiss debtors highly responsive.

    Timeline:10 days response
    Cost:Low

The cost of filing a Betreibung is nominal — typically CHF 50 to CHF 200 depending on the claim amount. This makes it one of the most cost-effective legal enforcement tools in Europe. The financial barrier to entry is so low that there's almost no commercial debt too small to pursue through the Swiss system.

Switzerland's dual approach to enforcement — Pfändung (seizure of assets) for individuals and non-commercial entities, and Konkurs (bankruptcy proceedings) for companies registered in the commercial register — provides clear, predictable routes to recovery.

INTERCOL's Zürich-based partners file Betreibungen across all 26 cantons in the appropriate language and format. For our international clients, the Swiss system offers something rare: a debt collection mechanism where the cultural and commercial consequences of non-payment are so severe that the debtor's own self-interest does most of the work.
